Terms of Service

These Terms of Service ("Terms") govern your access to and use of Postmixr(the "Service") at postmixr.com and related sites or applications we operate. By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. The Service

Postmixr provides tools to plan content, connect third-party social accounts, and schedule or publish posts on your behalf, subject to the features and limits of your plan and the policies of each platform (e.g. Meta, X, YouTube). We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable.

2. Eligibility and accounts

You must be able to form a binding contract in your jurisdiction to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us at privacy@postmixr.com if you suspect unauthorized access.

3. Acceptable use

You agree not to:

  • Violate applicable law or third-party rights;
  • Upload or distribute malware, or attempt to breach or overload our systems;
  • Use the Service to send spam, deceptive content, or content that infringes intellectual property;
  • Reverse engineer or scrape the Service except as allowed by law;
  • Misuse OAuth tokens or connected accounts, or access another user's data without authorization.

We may suspend or terminate access for conduct that violates these Terms or creates risk for us or others.

4. Connected platforms

When you connect a social account, you authorize us to access and use that account as permitted by you and by the platform's terms and APIs. You remain responsible for your content and for complying with each platform's rules. We are not responsible for outages, rate limits, or policy changes by third parties.

5. Content and intellectual property

You retain rights to content you submit. You grant us a limited license to host, process, and transmit your content solely to operate the Service (including publishing where you instruct us to). The Service, its branding, and our software are owned by us or our licensors and are protected by intellectual property laws.

6. Fees

Paid plans are billed as described at checkout. Unless stated otherwise, fees are non-refundable except where required by law. We may change pricing with notice; continued use after the effective date may constitute acceptance.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation or that content will be published successfully on every platform.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF YOU HAVE NOT PAID FEES.

9. Termination

You may stop using the Service and request deletion as described in our Data Deletion page. We may suspend or terminate your account for breach of these Terms or for legal or operational reasons. Provisions that by their nature should survive (e.g. disclaimers, limitations, indemnity) will survive termination.

10. Indemnity

You will defend and indemnify us against claims arising from your content, your use of the Service in violation of these Terms, or your violation of third-party rights or law, subject to our prompt notice and reasonable cooperation.

11. Governing law

These Terms are governed by the laws applicable to the entity operating Postmixr, without regard to conflict-of-law rules. Courts in that jurisdiction have exclusive venue, unless mandatory consumer protections in your country require otherwise.

12. Changes

We may update these Terms by posting a new version on this page and updating the "Last updated" date. Material changes may be communicated by email or in-product notice. Continued use after the effective date may constitute acceptance.
